Attorney Mike Vial Speaks Out Against HB 3746 in Oregon Legislative Hearing

The proposed bill would shorten the statute of repose for construction defect claims from 10 years to 7 years—an issue that Vial says could harm Oregon homeowners.

Speaking on behalf of the Oregon Trial Lawyers Association, Mike explained that many serious construction issues—like water intrusion—often take years to surface. Reducing the timeframe to bring legal action could prevent homeowners, especially those in low-income communities, from seeking repairs or holding developers accountable.

Supporters of the bill, including developers and some housing advocates, argue that it would help encourage more housing construction. However, opponents like Vial caution that this shift would come at the expense of consumer protections, leaving many homeowners to shoulder repair costs for issues they didn’t cause.
